In the fall of August 2000, a confirmed and convicted
batterer of Domestic Violence was given sole custody of his soon to be six
year old daughter Rikki, without a Material Change of Circumstance, mother,
Claudine Dombrowski has been residential Custodian since Rikki's Birth.
Since that time mother alleges physical abuse towards her daughter and
herself, with convincing evidence that the Courts refuse to hear. Mother filed
a motion for hearing in July 2001 for a change of custody
related to significant Changes in Material Circumstance as defined by the
Kansas State Law and The Shawnee County Family Guidelines. Such as a Move,
change in Job, (Mom doesn't have to work and is a stay at home mom) and a
marriage to highschool sweetheart. Theses are all significant Changes in
Circumstances outlined in the Laws.
Judge Anderson refused to set motion for hearing and sent a
letter to Harry Moore in Court Services Shawnee County, pro-dad and biased
towards Claudine, telling HIM to decide weather or not there should be a
hearing.
Of course in a 4 page report Harry Moore advocate for dad, decided there was
not to be a hearing, as he did not believe there needed to be one. This is NOT
in the Job description of Court Services Officer, nor is Harry Moore qualified
to make such a decision.
Even though this is a 'Constitutional violation...due
process, civil rights, the Judge can do and say whatever he wants and call it
"Judicial discretion"
to cover his ass, even though I can not find a Kansas Law or Statute giving
such a power to a judge citing 'Judicial discretion.'
Claudine Dombrowski is STILL trying to convince the Courts for a Hearing to
present evidence in a change of visitation / custody. Claudine and Rikki only
have two one hour visits a week, since January 2001, and all attempts to
change and or extend these visits have been denied by Harry Moore, Court
Services Officer.
"All I want (says mother) is to have a day in Court to present Evidence
as is our constitutional rights allow us." Mother continues to state
"The Shawnee County Courthouse is corrupt and
selling children to the abusers, lining their pockets with the blood of
innocent children." Rikki's dad still has the Childs coffin in his living
room as a constant reminder of who is in control. If anyone has any insight or
