Hello to all of you.....
I am BEGGING for help here. I know that most
if not all of you know that I filed a motion to leave the state of New
Jersey back in June. I have been in contact with the Ocean County Court
and have been speaking with the judges Law clerk.
Here is the situation...I NEED ADVICE PLEASE
I am shaking and AGAIN an injustice has been done to me and my children.
My X was supposed to be served by the court. I understand
that this is not the normal practice, however due to the extensive
violence and history in this case the court was going to have him
served. They have done this in the past for me as well.
The original service return receipt came back, as
undeliverable ( NO such address) meaning that the address's that He has
provided the courts with is false. Now this IS NOT the first time that
he has done this. This is repeated behavior for him.
I spoke to the law clerk this morning ( who was not very
helpful, and very short tempered) and she advised me that the court date
has been changed because the second address that was provided to the
court by HIS criminal probation officer was also false!!!
I was advised that there is nothing that I can do about
this. They said that there is no way that I can leave this state
until and if he is served, even though he is DELIBERATELY
doing this AGAIN!!
This is a COMPLETE INJUSTICE!!!!!!!!
There is nothing that I can do here. I was advised that
even though I have played by the rules, that if I remove my children
that he HAS NO RELATIONSHIP with that I will be
prosecuted, and will loose my children.
Again I am broke and am unable to afford an attorney. The
court told me that it was in my best interest to go and get one!!
this is impossible!!!!
They also told me that they have to follow the law as the
way that it was written here, however HE is NOT
and AGAIN there are no repercussions for him on this.
WHAT AM I SUPPOSE TO DO HERE??????
I am desperate, living with friends, and STILL after 5
years watching this man escape the system. The very system
that SHOULD be looking out for me and my children!!!!!!!
THIS IS NOT FAIR!!!
They also told me that even though he HAS NO
RELATIONSHIP with his children (which is by his choice at
this point) that there is NOTHING that I can do
here?????????
What is that all about?? Why is HE NOT being
violated based on the false addresses that he is providing to the
court?? Why is the court NOT willing to investigate this???? And
WHY am I forced to stay here in NJ even though HE is doing this on
purpose??????
I KNOW that once if I ever see the inside of the
court room, I can PROVE that there is no relationship, and that this man
has violated his probation/parole and that he IS doing
this to further abuse me and the children. These are documented FACTS!!!!!!!
I can't get him to the court or even get him served at
this point. WHY??????????????
GOD PLEASE ADVISE ME!! I need any and ALL
advice and opinions at this point...
Am I suppose to just take my children and notify the
court that I have left????? and give them the NEW address in NC OR
is that going to make me loose my children??????
I can not sit in NJ and wait for him to continue to make
the decisions for me and my children. I have been divorced for 5 years
now, and have over the years continued to be abused by the courts at the
hands of this man. WHY??????
There is NOTHING against me. I have done
and gone to EVERY appointed counselor, have been
investigated by Children Services, I have played by ALL the rules that
the court has set forth for me, and EVERY ONE
that has interviewed me and my children all say the SAME thing. That
this man is DANGEROUS and at any moment can snap and
kill US all. NOW he has tried this in the past, and by the skin of my
panties I made it out alive!! I explained to the court today that
my children and I are living now with a friend, and what are we suppose
to do??? Sit and wait for him to decide that it my day to
die????????
PLEASE HELP ME PLEASE HELP MY CHILDREN......................
